Abstract

This study aims to determine the legal protection of patient rejection and the role of the Department of Health in ensuring health care for the refusal of medical services to patients. Research method using normative legal approach, type of literature research, data analysis using qualitative analysis. The results showed that the refusal of medical care performed by the hospital against patients who need emergency care including unlawful acts and including criminal acts. Hospitals should not refuse patients who need medical treatment, acts of refusal of medical services including criminal acts, so that they can be criminally prosecuted in accordance with Articles 304 and 531 of the Criminal Code. In the event of refusal of hospital medical treatment, the hospital's leadership is responsible for violations of the law. In the responsibility for the refusal of medical treatment including unlawful acts that harm others (patients), this has been stipulated in Article 1365, 1366, 1367 of the Civil Code, if the act is against the law resulting in the loss of a person's life then it can be ensnared Article 1370 kuhPerdata. In an effort to avoid the act of denial of health services by hospitals, the role of the Department of Health is required by establishing a supervisory board of the health code of health in order to peck at health care is given well to the community.
